Terms and Conditions

Welcome to Yachting Punta Cana. By booking and participating in any activities or services provided by the Company (“Yachting Punta Cana,” “we,” “us,” or “our”), you (“the Client” or “the Guest”) agree to be bound by these Terms and Conditions. This document outlines the policies, responsibilities, and conditions of our services.

1. Booking and Payment

1.1. Reservation Confirmation

  • All reservations are confirmed upon receipt of full payment. Bookings made without payment are not guaranteed.

1.2. Accepted Payment Methods

  • Payments can be made via credit card, debit card, or other methods approved by Yachting Punta Cana.

1.3. Booking Amendments

  • Requests to amend bookings must be made in writing and are subject to availability. Additional fees may apply.

1.4. ID Verification

  • Guests are required to upload a valid government-issued ID (passport, driver’s license, or national ID) at the time of booking. Failure to provide valid identification may result in the cancellation of the booking without refund.
2. Cancellation and Refund Policy

2.1. Cancellations by the Client

  • Cancellations made 72 hours or more prior to the scheduled excursion will receive a full refund.
  • Cancellations made within 72 hours of the scheduled excursion are non-refundable.

2.2. Cancellations by Yachting Punta Cana

  • We reserve the right to cancel or reschedule excursions due to weather conditions, safety concerns, or other unforeseen circumstances.
  • In such cases, Guests may choose between:
    • A full refund.
    • Rescheduling to an available alternative date.

2.3. No-Shows and Late Arrivals

  • Guests who arrive late or fail to show up for the excursion forfeit their booking and any payments made. No refunds or rescheduling will be offered.

2.4. Unforeseen Events

  • Refunds and cancellations are not provided for changes in travel plans, missed transportation, or other Guest-related circumstances beyond our control.
3. Code of Conduct and Safety

3.1. Compliance with Instructions

  • Guests are required to follow all safety instructions and guidelines provided by the captain and crew. Non-compliance may result in immediate removal from the excursion without refund.

3.2. Prohibited Activities

  • Smoking and the consumption of alcohol by persons under the age of 21 are strictly prohibited onboard.
  • Guests exhibiting disruptive, unsafe, or inappropriate behavior may be removed from the vessel at the captain’s discretion without refund.

3.3. Supervision of Minors

  • Guardians are responsible for supervising children at all times during the excursion.

3.4. Health and Fitness Requirements

  • Guests must disclose any medical conditions, including pregnancy, that may affect their ability to participate. The Company reserves the right to deny participation to individuals deemed unfit for activities.
4. Assumption of Risk and Liability

4.1. Acknowledgment of Risks

  • Guests acknowledge that yachting excursions involve inherent risks, including injury, illness, property damage, or death. Participation is at the Guest’s own risk.

4.2. Release of Liability

  • By participating in activities, Guests release Yachting Punta Cana, its employees, agents, contractors, and affiliates from any claims, demands, or causes of action arising from injuries, losses, or damages incurred during the excursion, whether caused by negligence or otherwise.

4.3. Personal Property

  • Yachting Punta Cana is not responsible for the loss, theft, or damage of personal property during the excursion.
5. Third-Party Services

5.1. Independent Contractors

  • Yachting Punta Cana contracts with independent third-party service providers for certain services, including yacht operations and ground transportation.

5.2. Limitation of Liability

  • Yachting Punta Cana is not liable for actions, omissions, errors, or negligence by third-party service providers. Claims for injury, loss, or damages must be directed to the applicable provider.
6. Media and Privacy

6.1. Consent to Photography/Filming

  • By participating in excursions, Guests consent to being photographed or filmed. Such media may be used for promotional purposes without compensation.

6.2. Data Collection and Use

  • Personal data, including ID images, will be collected and stored securely for booking verification and compliance purposes. Data will be handled in accordance with applicable privacy laws and deleted when no longer needed.
7. Dispute Resolution

7.1. Non-Disputability of Charges

  • Payments made for non-refundable bookings are final. By accepting these Terms, Guests waive the right to dispute any non-refundable charges through their bank or credit card provider.

7.2. Governing Law

  • These Terms are governed by the laws of the Dominican Republic.

7.3. Jurisdiction

  • Any disputes shall be resolved exclusively in the courts of Punta Cana, Dominican Republic.

7.4. Legal Fees

  • In the event of a dispute where Yachting Punta Cana prevails, the Guest agrees to reimburse the Company for all associated legal fees, costs, and damages.
8. Force Majeure

8.1. Unforeseen Events

  • Yachting Punta Cana is not liable for cancellations, delays, or modifications due to events beyond its control, including but not limited to weather, natural disasters, government actions, or mechanical failures.
9. Acceptance of Terms

By booking with Yachting Punta Cana, the Guest confirms that they:

  • Have read and understood these Terms and Conditions.
  • Agree to abide by all policies and guidelines outlined herein.
  • Understand the cancellation, refund, and liability policies.
